PAYMENT
Payment is accepted through Paypal, Chime, and Cashapp primarily.
Client can request to use an alternate banking platform, and should be agreed upon between the artist and client.
All payment will be HALF OR FULL UPFRONT as agreed upon.Prices can increase or decrease depending on demand from the client, or financial hardship.
The needs of the client or artist may impact the agreement and progression of the project, without consequence so long as communication is present.
Absence of communication on this subject may terminate this agreement.RIGHTS TO ASSETS
The assets created for the client are meant for personal, non-commercial purposes.
Client may not claim artwork as their own.
Client must not use artwork nor any assets for projects, NFT's.
Client must credit the artist when sharing the artwork in any way, including but not limited to social media platforms.
Client may never use any artworks for use in generative image training, promoted as, or alongside any artificially generated media.
The artist retains a portion of the intellectual property of all artworks.
The artist has the right to display any work for promotional purposes.
The artist retains the right to the original artworks and files.
Any desired alterations to these guidelines must be agreed upon by both client and artist, as well as additional compensation.-Alterations
The client is allowed up to 3 alterations, they must be agreed upon between artist and client.
Any requested alterations deemed too significant or excessive may be subject to additional charges.
The artwork is not to be altered by the client after completion without written consent from the artist.-Release of assets
Completed artworks will be released to the client via their preferred method, including but not limited to, Vgen, Email, or social media messaging platforms.
No completed artwork will be released to the client without prior collection of payment. Failure to provide payment may result in a Breach of TOS.BREACH OF TOS
The client and artist agree to all terms, any action taken willingly or unknowingly, to violate these terms, may result in a Breach of TOS.
Actions that qualify as Breach of TOS Include but are not limited to:
Failure to provide payment for assets.
Failure to credit artist when displaying artwork.
Violating Rights to Assets.
Failure to communicate requests for alterations.
Excessive alterations to artwork.
Intolerable treatment towards artist or artworks.
Requesting artwork that the artist is uncomfortable with or has turned down prior.
Clients continued dissatisfaction with completed assets.
Failure to provide client with completed assets.If these terms are breached, unsatisfactory, the client and artist may discuss and agree upon resolving and ending the project, or adjusting the terms to fit the client and artists needs.
If the TOS is breached after progress has been made on the assets, the artist and client are entitled to compensation equal to progress made. (Ex: Client has paid full upfront for a fully rendered piece, and the artist has only progressed half way at the time of the Breach of TOS, half of the payment will be returned to the client through the same methods it was received.)By going through with the commission, you are confirming you have read and agree with these terms and conditions.
